I believe that Rockstar secretly released the patch under a pseudonym. Plus the PC is a third of the market, why loose a third of your business?

Seriously, as long as a company can be sued for the actions of other people, then they will not do anything that might get them sued, unless they are fairly sure that they will make more profit than they will be sued for, at which point is just turns into a cost of business.

Rockstar did loose money from the Hot Coffee scandal, but mainly they got a huge amount of free publicity. They got more free publicity than it cost them.
